1. Acceptance of Terms
By accessing or using the ServCalc App ("App"), you agree to be bound by these Terms and Conditions ("Terms") as well as the terms and conditions of FatSecret, our nutrition data provider. If you do not agree, you may not use the App.
2. Eligibility
You must be at least 18 years old to use the App. By using the App, you represent that you meet this age requirement.
3. No Medical Advice
The App provides general nutrition information and tools for informational purposes only. It is not intended to offer medical advice, diagnose, treat, or prevent any health conditions. Consult a qualified healthcare professional before making dietary changes or decisions based on the App content.
4. Subscription and Billing
- **Subscription**: The App operates on a monthly subscription model. Your subscription will automatically renew each month unless canceled.
- **Payment**: You authorize us to charge your provided payment method monthly. You are responsible for ensuring your payment information is accurate and up to date.
- **Cancellation**: You may cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of the current billing cycle, and no partial refunds are provided.
- **Refunds**: Subscriptions are non-refundable, except as required by law.
5. User Conduct
You agree to use the App only for lawful purposes and in a manner that does not infringe the rights of others. Prohibited activities include, but are not limited to:
- Sharing your account credentials with others.
- Posting or transmitting harmful, unlawful, or offensive content.
- Attempting to gain unauthorized access to our systems.
6. Intellectual Property
All content, including text, graphics, logos, and software, is owned by or licensed to us. You may not copy, distribute, or create derivative works without our prior written consent.
7. Privacy
Your use of the App is subject to our Privacy Policy, which governs the collection and use of your personal information.
8. Termination
We may suspend or terminate your access to the App at our discretion, with or without notice, for any violation of these Terms or for any other reason.
9. Limitation of Liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the App, including any health-related outcomes. Our total liability is limited to the amount you paid us for the App subscription.
10. Indemnification
You agree to indemnify and hold us harmless from any claims, losses, or damages, including legal fees, arising from your use of the App or violation of these Terms.
11. Modifications to Terms
We may update these Terms at any time. We will notify you of changes via the App or email. Continued use of the App after changes constitutes your acceptance of the new Terms.
12. Governing Law
These Terms are governed by the laws of the State of Oklahoma USA, without regard to its conflict of law principles. Any disputes shall be resolved in the courts of Tulsa, Oklahoma
